{"id":469,"date":"2021-07-28T20:04:43","date_gmt":"2021-07-28T20:04:43","guid":{"rendered":"https:\/\/pressbooks.ulib.csuohio.edu\/understanding-literacy-in-our-lives\/?post_type=chapter&#038;p=469"},"modified":"2021-08-09T16:02:21","modified_gmt":"2021-08-09T16:02:21","slug":"3-7-2-the-discourse-of-law-prospectus","status":"publish","type":"chapter","link":"https:\/\/pressbooks.ulib.csuohio.edu\/understanding-literacy-in-our-lives\/chapter\/3-7-2-the-discourse-of-law-prospectus\/","title":{"rendered":"3.7.2 The discourse of law (prospectus)"},"content":{"raw":"<h3>English 102, November 2020<\/h3>\r\n<div>\r\n<p class=\"paragraph\"><span class=\"normaltextrun\"><span>For my prospectus essay I wanted to<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>look at the topic of<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>law literacy through the<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>lens<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>of discourses<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>and language used.<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>I am going to<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>use a<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>few sources<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>and I want to divide the essay and its paragraphs based on the sources. So, I am going to write one essay about each source and what the author is saying<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>and the implications of what they are saying on the overall topic and how they relate to other sources used in the paper.<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>I want to highlight how these authors<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>have different and similar ideas about how<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>law literacy is used within the field. These similarities and differences can show a lot about the differences between the different ideas on the same<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>topic. I<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>want to use the first source, the four<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>discourse<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>of law and Arthur Jacobson\u2019s legal premium as an anchor for my paper with most, if not<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>all of<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>the<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>sources connecting back to that source.<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>I want to show that there is not one set way in which to study the discourse of law.\u00a0<\/span><\/span><span class=\"eop\"><span>\u00a0<\/span><\/span><span><\/span><\/p>\r\n\r\n<\/div>\r\n<div>\r\n<p class=\"paragraph\"><span class=\"normaltextrun\"><span>Maybe go into Gee article and explore some ideas<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>that could relate to the overall narrative of the law discourse.<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>I like the idea of power in that<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>comes with the discourses and the acquisition of discourses. I also might want to go into the international aspect<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>of Gee\u2019s article and see how that may connect.\u00a0<\/span><\/span><span class=\"eop\"><span>\u00a0<\/span><\/span><span><\/span><\/p>\r\n\r\n<\/div>\r\n<div>\r\n<p class=\"paragraph\"><span class=\"normaltextrun\"><span>Or I can give an overview of the law discourse and maybe show its uses before I go into the academic stuff.\u00a0<\/span><\/span><span class=\"eop\"><span>\u00a0<\/span><\/span><span><\/span><\/p>\r\n\r\n<\/div>\r\n<div>\r\n<p class=\"paragraph\"><span class=\"normaltextrun\"><span>The first source I want to use is<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>The<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>four discourses of law and Arthur Jacobson's legal premium by Jeanne L Schroder. This author says that under the overall discourse of law there are<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>three<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>main sub discourses. These sub discourses are university discourse, analysts' discourse,<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>and<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>hysterics<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>discourse. University discourse is academic language used in law. Some examples of this discourse are academic journals and language used to teach law.<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>Analysts<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>discourse is when one is analyzing case law. This is mainly used by lawyers when preparing for a case.<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>Hysterics discourse is<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>looking at the overall discourse in a social setting and how it is used casually, not in a professional<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>setting<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>.<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>I want to walk through the basics<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>of the four different discourses they describe<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>and how they work together in the field of law. I also was to highlight in<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>all of<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>my sources the difference between basic ideologies of law literacy. This is because in the most basic sense some people seem<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>to disagree on how the discourse of law works. Some believe that the discourse is not a whole discourse and that you can only study the discourse of law based<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>on the actual practice of law that is being used at that time. However, some believe that<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>all of<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>these<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>practices are so interconnected<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>and fluid that the discourse of law can only be studied as a whole discourse, not through the lens of each sub discourse.<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>I want to connect this to my overall greater point which is that there is not one set way in which to<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>study the discourse of law.<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>I want to show through the paper how these different sources clash with each other and<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>are all still valid<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>analysis\u2019<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>of the discourse of<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>law.\u00a0<\/span><\/span><span class=\"eop\"><span>\u00a0<\/span><\/span><span><\/span><\/p>\r\n\r\n<\/div>\r\n<div>\r\n<p class=\"paragraph\"><span class=\"normaltextrun\"><span>The next source I want to use is<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>'Global Value Chain' a Legal<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>Concept?:<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>Situating Contract Law in Discourses Around Global Production. The author argues that in a global production community there are many different discourses that<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>fuse to create<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>global production. So, as a result there is a global discourse shared all over the world that is forming because of global production, this relationship works<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>causally, meaning that they both affect each other and cause each other to happen. They also say that a big aspect of this discourse is contract law.<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>So<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>the contract law discourse is what is being influenced most right now. I want to go more in depth on the<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>interdependency of the sub discourses and how they are not only influenced by other discourses and law literature, but they are<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>also influenced by the world.<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>I want to highlight how these<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>are practical and used in everyday life.<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>This is more a study of a specific sub discourse than<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>of the topic rather than a study over the overall discourse like the first source<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>however these two topics can still be compared.<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>This agrees with the previous source because they also believe that the discourse is fluid and<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>everchanging. I want to discuss this and a few more similarities and differences.\u00a0<\/span><\/span><span class=\"eop\"><span>\u00a0<\/span><\/span><span><\/span><\/p>\r\n\r\n<\/div>\r\n<div>\r\n<p class=\"paragraph\"><span class=\"normaltextrun\"><span>The next source<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>I<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>want to use relates to the<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>previous one and shows how global and practical the discourse of law really is. the next source<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>I<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>want to use is power of discourse in free trade agreement<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>negotiation. This<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>author discusses the overall theory of discourses. he says that with certain discourses comes powers. he says that this helps greatly in free trade agreement negotiation. this is because discourses will give you power and leverage in these negotiations.<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>I might also want to bring in Gee and his work because it can bring in another supportive<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>voice in this because he talks about how power comes with different discourses<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>and how that can be used day to day.\u00a0<\/span><\/span><span class=\"eop\"><span>\u00a0<\/span><\/span><span><\/span><\/p>\r\n\r\n<\/div>\r\n<div>\r\n<p class=\"paragraph\"><span class=\"normaltextrun\"><span>The next source I want to go into is \u201cDiscourse Analysis of Legal Discourse with Reference to Dickens, Cozzens, Kafka, Lee, and Melville\u201d. This source<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>talks about the discourse of law internationally and shows how these laws internationally are similar and different. They go into how many discourses in different countries and cultures have similar nomenclature.<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>This is because of the nature of laws that<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>they are meant to control people, this is not necessarily a bad thing though.<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>But<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>I want to connect that with the power that is talked about with discourses<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>of the previous source and gee\u2019s article.<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>I want to show that overall, throughout the<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>various sources that the discourse of law does have power. This power is ingrained<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>within the discourse<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>and is a universal part of the discourse. I also want to talk that not only do they have the same purpose and power with<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>it<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>but it also<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>comes the same language, so I want to talk about how some of those words themselves carry connotations with them across languages and this is probably due to the<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>connection with the discourse of law and that is what<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>gives it that connotation. I want to explore that and a few more ideas of how this connects with<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>the other sources.<\/span><\/span><span class=\"eop\"><span>\u00a0<\/span><\/span><span><\/span><\/p>\r\n\r\n<\/div>\r\n<div>\r\n<p class=\"paragraph\"><span class=\"normaltextrun\"><span>The<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>overall larger point that I want to get at in this paper<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>is that the discourse of law internationally is not uniform, because the culture plays into the discourse of law so much, but they have the same building blocks. The discourse has the same purpose,<\/span><\/span><span class=\"apple-converted-space\"><span>\u00a0<\/span><\/span><span class=\"normaltextrun\"><span>power, and language usage internationally. I also want to highlight that most sources identify that discourse is fluid and changes with culture. This is because in the most basic sense some people seem<\/span><span class=\"apple-converted-space\">\u00a0<\/span><span class=\"normaltextrun\">to disagree on how the discourse of law works. Some believe that the discourse is not a whole discourse and that you can only study the discourse of law based<\/span><span class=\"apple-converted-space\">\u00a0<\/span><span class=\"normaltextrun\">on the actual practice of law that is being used at that time. I want to go more in depth on the<\/span><span class=\"apple-converted-space\">\u00a0<\/span><span class=\"normaltextrun\">interdependency of the sub discourses and how they are not only influenced by other discourses and law literature, but they are<\/span><span class=\"apple-converted-space\">\u00a0<\/span><span class=\"normaltextrun\">also influenced by the world.<\/span><span class=\"apple-converted-space\">\u00a0<\/span><span class=\"normaltextrun\">I want to highlight how these<\/span><span class=\"apple-converted-space\">\u00a0<\/span><span class=\"normaltextrun\">are practical and used in everyday life.<\/span><span class=\"apple-converted-space\">\u00a0<\/span><span class=\"normaltextrun\">This is more a study of a specific sub discourse than<\/span><span class=\"apple-converted-space\">\u00a0<\/span><span class=\"normaltextrun\">of the topic rather than a study over the overall discourse like the first source<\/span><span class=\"apple-converted-space\">\u00a0<\/span><span class=\"normaltextrun\">however these two topics can still be compared.<\/span><span class=\"apple-converted-space\">\u00a0<\/span><span class=\"normaltextrun\">This agrees with the previous source because they also believe that the discourse is fluid and<\/span><span class=\"apple-converted-space\">\u00a0<\/span><span class=\"normaltextrun\">everchanging.
